SPONSOR: “Sponsor” is American Standard, 30 Knightsbridge Road, Suite 301 Piscataway, New Jersey 08854. This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram, Meta/ Facebook, Twitter or other similar social media entities. Entrant understands that he/she is providing his/her information to Sponsor and contest sponsors’ to Instagram, Facebook/Meta and not to Instagram, Facebook/Meta.

ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia. Persons residing in other jurisdictions are not eligible to enter the Sweepstakes. You must be at eighteen (18) years of age at the time to entry. Officers, directors, and employees of Sponsor , and members of immediate families (biological, step or in-law) including parent, grandparent, child, sibling, or spouse of any of the foregoing (regardless of where they live) or households of any of the above, whether related or not, IRS dependents, and household members of Sponsor and its respective parents, affiliates, subsidiaries, advertising, parents, affiliated entities, directors, officers, employees, attorneys, agents, and representatives promotion, and web design agencies (collectively, the “Released Parties”),  and all other entities involved in the creation, administration, or fulfillment of the Sweepstakes is not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. By entering this Sweepstakes, Entrants agree that they have read these Official Rules, the Instagram, Facebook/Meta terms and policies and agree to abide by and to be bound by the terms and conditions of the Official Rules. False and/or deceptive entries or acts shall render entrants ineligible. Sponsors’ and Administrator’s decisions are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

SWEEPSTAKES PERIOD: Sweepstakes will begin on December 1, 2021, at 12:00 AM Eastern Time (“ET”) and ends on December 26, 2021 at 12:00 AM ET (“Closing Date”). Sponsor’s designated computer is the official time-keeping device for the Sweepstakes.

HOW TO ENTER:

Submit a video and/or photo of your family in the kitchen during the holiday season via a public post on Instagram using the hashtag #REELFamilyHolidays and tagging @American_Standard and/or Facebook/Meta using the hashtag #REELFamilyHolidays and tagging @AmericanStandardPlumbing

No other method of entry will be accepted. [Limit one (1) entry per person using only one (1) Instagram and/or Facebook/Meta account through the Sweepstakes Period”] Entries generated by script, macro, or other automated or improper means are void. Entries that meet the requirements included in these Official Rules are referred to herein as “Eligible Entries.” The awarding of the Prizes, as defined below, is subject to the eligibility and forfeiture provisions set forth herein.

SWEEPSTAKES ENTRY: Participation constitutes Entrant’s unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Only eligible entries actually received by Sponsor before the Closing Date will be included in the Sweepstakes drawing. Any information collected from Entrants is subject to Sponsor’s Privacy Policy located at https://www.americanstandard-us.com/privacy-policy (the ‘Website’).

ENTRY REQUIREMENTS: All Entries must: 1) Be the original creation of the Entrant; 2) Not have won any type of previous recognition awards (regardless of compensation); 3) Not have been previously published or produced in any fashion (regardless of compensation); 4) Not infringe on any third-party rights; 5) Be suitable for publication as determined at the sole and absolute discretion of the Sponsor; 6) Not include, obscenity, profanity, racist themes or material that is sexually oriented or comments regarding sexual orientation, explicit, suggestive or exploits people in a sexual or violent manner; and 7) Not contain other brands’ name, labels or logos.  Any Entry deemed inappropriate for any reason, as determined at the sole and absolute discretion of the Sponsor, will not be considered. Modification of an existing work does not qualify as original. In order to be entered into the Promotion, Entrant must comply with the Entry instructions and each Entry submitted must meet the eligibility criteria outlined above. Once submitted, an Entry cannot be modified.

LIMIT ONE (1) ENTRY PER PERSON: Multiple Entrants are not permitted to share the same email address or social media profile. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, profiles, registrations and logins, or any other methods, will void that Entrant’s entries and that Entrant will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to the identity of any Entrant, entry will be declared made by the Authorized Account Holder of the email address used at the time of entry. Any winner may be required to provide Sponsor with proof that such winner is the Authorized Account Holder of the winning entry. The ‘Authorized Account Holder’ is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning email addresses.  If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries. Sponsor reserves the right to ship prizes directly to the mailing and/or e-mail address (as applicable) provided by winners during their entry to the Sweepstakes. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive e-mail account(s), spam, or technical difficulties. No transfer, substitution or cash redemption will be awarded in lieu of Prize. Prizes may take up to 8-12 weeks to arrive from final selection and agreed upon product(s). An entrant or winner may be disqualified from the Sweepstakes, and his or her entry may be deleted, if he or she fails to comply with each provision of these Official Rules and Regulations, as determined in the sole discretion of the Sponsor. Participation in the Sweepstakes is at entrant’s own risk.

USAGE RIGHTS IN ENTRIES: Sponsor and its designees shall have the unrestricted and non-exclusive right to edit, adapt, publish, copy, display, perform, broadcast, modify, and otherwise use any or all entry materials, alone or in combination with other material in any and all media, whether now known or later discovered, in perpetuity, without restriction of any kind whatsoever, without further compensation to the Entrant or anyone else.  Sponsor reserves the right to review any such Entry prior to any posting, to remove any Entry at any time after posting, and to remove any incidental material that could be deemed infringing where doing so would not materially alter the Entry and where the Entrant otherwise clearly intended to comply with these Official Rules, as determined by Sponsor.  Potential winners may be required to assign all rights in entry to Sponsor without additional compensation.  Entries will become visible to the public via Instagram, Facebook/Meta and are subject to the usage terms of those platforms. Entries will be deemed posted at the direction of the Entrant within the meaning of the Digital Millennium Copyright Act and the Communications Decency Act.

SELECTION OF WINNER: On or around December 27, 2021, representatives of the Sponsor will randomly select from all eligible entries received during the Sweepstakes Period one (1) Winner. “Prize Winner” to win one Prize, as defined below. The selection will be conducted by Sponsor, and Sponsor’s decisions will be final in all matters pertaining to the selection. Any potential Prize Winner may be subject to the verification by Sponsor of eligibility and compliance with these Official Rules. An Entrant is not a winner of the prize until Entrant’s eligibility as a Prize Winner has been verified, Entrant has been notified that the verification is complete, and Entrant has complied with the terms and conditions of these Official Rules. The number of eligible entries received during the Contest Period determines the odds of winning. The Sweepstakes will be conducted under the supervision of the Sponsor. If a winner is determined to be ineligible, forfeits or does not claim a prize, the prize may be re-awarded, in Sponsor’s sole discretion, based on a subsequent drawing from the pool of eligible entries. Other restrictions may apply. Decisions of the Sponsor are final and binding with respect to all matters related to the Sweepstakes. All prizes will be awarded. In the event of a lost, misdirected, or otherwise unavailable prize, a prize of equivalent value will be awarded.  In no event shall the Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules and Regulations. Winners shall be responsible and liable for all federal, state and local taxes on the value of their prize.

AWARDING OF PRIZE: A representative of Sponsor will notify the Prize Winner by direct message via Instagram and/or Facebook/Meta within one (1) business day after winner determination. Potential winner must respond to the notification within five (5) days with all requested information to confirm eligibility and to arrange for delivery of prize.  Potential winners may be required to execute and return an affidavit of eligibility, release of liability, and except where prohibited, publicity release within five (5) days of notification. Noncompliance with this time period may result in disqualification and award of prize to an alternate winner at the sole discretion of the Sponsor. If a potential winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if any prize or prize notification is returned as undeliverable, that potential winner will be disqualified and prize may be awarded to an alternate winner.  If any eligible winner is deemed a minor under the laws of his or her state or province of residence, a parent or legal guardian must sign any necessary prize claim documents. Sponsor is not responsible for contacting an Entrant if that Entrant has changed contact information and failed to provide Sponsor with the proper contact information when such information is required.


PRIZE/APPROXIMATE RETAIL VALUE (“ARV”): $25,000. Limit one (1) prize.

PRIZE CONDITIONS: All taxes and other expenses, costs or fees associated with the acceptance and/or use of the prize are the responsibility of the winner. The Prize Winner will be solely responsible for all federal, state, and/or local taxes, and for any other fees or costs associated with the Prize they receive, regardless of whether it, in whole or in part, is used. Any portion of any Prize not accepted by the Prize Winner will be forfeited. If any Prize is lost, destroyed or stolen it will not be replaced. Prize cannot be transferred by winner or redeemed for cash.  Sponsor reserves the right to substitute prize for one of equal or greater value if the advertised Prize becomes unavailable. Prize will be awarded “as is” with standard manufacturer warranties and guarantees.  Instagram and Facebook/Meta are not a Sponsor of, or in any way associated with, the Promotion. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period.

TAXES: Any valuation of the prize(s) stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner may be reported to the IRS as required by law. Each winner is solely responsible for reporting and paying any and all applicable federal, state, and local taxes, related to prize acceptance and use not specified herein. Each winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Sponsor in a calendar year will be issued an IRS Form 1099 reporting the value of those prizes to the IRS.


ACCEPTANCE OF PRIZE: By entering or accepting a prize in the Sweepstakes, winners agree to be bound by these Official Rules and Regulations and to conform to all federal, state and local laws and regulations. When applicable, the winner may be required to execute and return to Sponsor within three (3) business days an Affidavit of Eligibility, a Liability and Publicity Release and relevant tax forms to be eligible for the prize or an alternate winner may be selected. Winner may be required to furnish proof of identity, address and birth date in order to receive a prize. By entering, an entrant agrees to indemnify, release and hold harmless Sponsor and each of its respective parents, affiliates, subsidiaries, advertising, parents, affiliated entities, directors, officers, employees, attorneys, agents, and representatives promotion, and web design agencies (collectively, the “Released Parties”) from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, “Claims”) that may arise from their acceptance, possession and/or use of any prize or their participation in the Sweepstakes, or from any misuse or malfunction of any prize awarded, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter. Released Parties are not responsible or liable to any entrant or to any winner or any person claiming through such winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties’ sole control.

RELEASE: By entering the Sweepstakes, each Entrant agrees for him/her/itself and all heirs, executors, administrators (a) to release and hold harmless the Released Parties/Instagram and Facebook/Meta from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not from participation in the Promotion and/or acceptance, possession, use or misuse of any prize or any portion thereto to release, discharge, indemnify, defend, and hold harmless Sponsor, Instagram, Facebook/Meta and their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, members, employees, agents, and agencies from and against any demands, claims, liability, costs, losses, damages, or cause of action, including without limitation, personal injury, death, or damage to or loss of property, arising out of, in whole or part, directly or indirectly, whether caused by negligence or not from participating or attempting to participate in the Sweepstakes or from acceptance, possession, misuse, use, or award of the Prize. The Prize Winner shall bear all risk of loss or damage to their Prize after they have been delivered.  (b) to indemnify Released Parties from any and all liability resulting or arising from the Promotion;  (c) if selected as a Winner, to the posting of such Entrant’s name online and the use by Released Parties of such winner’s name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use, except where prohibited by law; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Promotion itself, and to be bound by all decisions of the Promotion judges, which are binding and final. Failure to comply with these conditions may result in disqualification from the Promotion at Sponsor’s sole discretion. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Promotion.


GENERAL CONDITIONS: The Sponsor’s administration and operation of the Sweepstakes and the selection of the potential Prize Winner are final and binding in all matters related to the Sweepstakes. Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. In the event any Prize Winner engages in behavior that (as determined by Sponsor or any prize provider in its sole and absolute discretion) is obnoxious, inappropriate, threatening, illegal, or that is intended to annoy, abuse, threaten, or harass any person, Sponsor reserves the right to terminate the Sweepstakes or withdraw the Prize. Sponsor reserves the right to ask any Entrant to remove any reference to the Sweepstakes or Sponsor posted on social media in connection with the Sweepstakes, or to remove a comment or photograph from Sponsor’s social media page if the Sponsor believes, in its sole discretion, that: the comment or photograph is obnoxious, inappropriate, threatening, illegal; is intended to annoy, abuse, threaten, or harass any person; is in violation of a third-party’s copyright, trademark, right of publicity, or other intellectual property rights, defames, libels, or commits any other tort against a third-party; or makes any statements concerning any third-party products, made as comparisons to Sponsor’ products or otherwise.

INTELLECTUAL PROPERTY: Entrants, upon submission of their entry to the Sweepstakes, hereby irrevocably grant to Sponsor, and each of its licensees, successors and assigns, during the Entry Period an exclusive, and thereafter the non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the Submission submitted as part of the Sweepstakes, and all elements, images, text and materials depicted therein, in whole or in part, in any manner or medium nor or hereafter known or devised throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it without having to give any compensation or attribution to entrants except for the awarding of the prize in the Sweepstakes. Sponsor, and each of its successors, assigns and licenses, will have the right to make unlimited derivative works therefrom, to assign or transfer any or all such rights and to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, Sponsor will have the right to use the submissions submitted as part of the Sweepstakes, and all images depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Entrants hereby waive and relinquish all so-called “moral rights (droit moral)” now or hereafter recognized in connection with submissions submitted as part of the Sweepstakes. Entrants acknowledge that as a condition of participating in the Sweepstakes and/or being selected as a Winner, Sponsor may request that the entrant’s submission, and any rights therein, be assigned to Sponsor and entrants may be required to confirm such assignment by completing and submitting the Prize Acceptance Documents (and any other documents reasonably required by Sponsor) or such entrant will otherwise be disqualified from receiving their prize. Entrants must maintain the ability to assign all such rights to Sponsor free of any limitations, restrictions or third party obligations. Entrants agree that Sponsor shall have sole discretion in determining the extent and manner of use of submissions and are not obligated to use any submission. Entrants agree not to issue any publicity concerning Sponsor. Entrants agree that neither Sponsor, nor its agents, shall be responsible for return or preservation of the submissions submitted. All submissions that are posted on Instagram and Facebook/Meta are available to be viewed by anyone with access to the Internet. Each entrant acknowledges that other entrants may have created ideas and concepts contained in their submission that may have familiarities or similarities to his/her own submission, and that he/she will not be entitled to any compensation or right to negotiate with the Released Parties because of these familiarities or similarities. The decisions of the Sponsor are final and binding in all matters relating to the Sweepstakes, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name (first name and last initial), address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. Sponsor reserves the right to request from entrant at any time proof that entrant maintains all necessary rights in their submission in order to grant Sponsor the rights required herein in a form acceptable to Sponsor. Failure to provide such proof may lead to, among other things, the entrant being disqualified from the Sweepstakes.

REPRESENTATIONS, WARRANTIES, AND INDEMNITY: Each entrant represents and warrants that he or she has read, understands and will follow the Official Rules. Entrants further represent and warrant that their submission and all materials and matter therein: (1) (except for elements that are within the public domain) are wholly original with such entrant and are not a copy or imitation of any other material; (2) will not infringe or violate any right, including, without limitation, any personal rights (e.g., defamation, privacy, false light, moral right, etc.) or any property rights (e.g., copyright, trademark, right to ideas, etc.) of any person or entity and the use thereof will result in no third party liability or obligations; and (3) is not the subject of any threatened or pending litigation claim or dispute that might give rise to litigation, which adversely affects or in any way prejudices, impairs or diminishes the right granted hereunder or the value thereof. Each entrant further represents and warrants that he or she has the right to agree to and fully perform consistent with these Official Rules and the consent of no third parties are required to grant the rights hereunder. Entrant further acknowledges and agrees that he/she has not previously granted, assigned or otherwise hypothecated his/her submission shall not violate an agreement to which such entrant has signed. Entrants agree (as permitted by applicable law) to indemnify and hold the Released Parties harmless from and against any third party claims, to the extent relating to any breach of any representation, warranty or covenant made by such entrant in connection with his or her acceptance of these Official Rules or Sweepstakes activities.

ADDITIONAL TERMS: Sponsor reserves the right to permanently disqualify from any promotion any person it believes has violated these Official Rules. Any attempt to deliberately damage the Promotion or the operation thereof is unlawful and subject to legal action by Sponsor, who may seek damages to the fullest extent permitted by law. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, pandemic, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Sponsor (excepting compliance with applicable codes and regulation) or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to Entrants’ or any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Promotion. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind, for inaccurate transcription of entry information, for errors in any promotional or marketing materials in these Official Rules, for any human or electronic error, or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged or returned.  Sponsor reserves the right to modify, extend, suspend, or terminate the Promotion, in whole or in part, if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper administration of the Promotion as contemplated herein.  If the Promotion is terminated before the designated end date, Sponsor will (if possible) select the winner from among the Entries received unaffected by the problem. Sponsor may prohibit any participant or potential participant from participating in the Promotion, if such person or entity shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other Entrant, Sponsor, or Sponsor agent or representatives; or behaves in any other disruptive manner (as determined by the Sponsor in its sole discretion). Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Promotion.

LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website or mobile device users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized access to the Website, Sponsor’s social media page, or any Entrant’s personal social media website. The Sponsor is not responsible for injury or damage to Entrant’s or to any other person’s mobile device, computer, or other electronic device related to or resulting from participating in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in the sole opinion of Sponsor, deems could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes and select Prize Winner from entries received prior to the action taken or in such other manner as Sponsor may deem fair and appropriate. Sponsor does not authorize, condone, sponsor, encourage or take responsibility for Entrants’: (1) unauthorized use of any third-party’s intellectual property, including copyrights and trademarks; (2) commission of any torts, including libel, defamation, and violations of rights of privacy and publicity; and (3) statements concerning any third-party products, made as comparisons to Sponsor’s products or otherwise, in connection with this Sweepstakes.

The Sweepstakes is strictly for promotional and entertainment purposes and may not be used in connection with any form of gambling. In the event Sweepstakes is challenged by any legal or regulatory authority, Sponsor reserves the right to terminate the Sweepstakes, or to disqualify entrants residing in the affected geographic areas. In such event, the Sponsor shall have no liability to any entrants who are disqualified due to such an action. Sponsor reserves the right to modify these Official Rules and Regulations in any way or at any time. Sponsor reserves the right, in its sole discretion, to cancel or suspend Sweepstakes should viruses, bugs or other causes beyond its control corrupt the administration, security or proper play of the Sweepstakes. In the event any portion of the Sweepstakes is compromised by any non-authorized human intervention, actions of entrants, or other causes beyond the control of Sponsor, which, in the sole opinion of Sponsor, corrupt or impair the integrity, administration, security, or operation of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to suspend, modify, abbreviate or terminate the Sweepstakes without further obligation. If Sponsor elects to abbreviate the Sweepstakes, winner(s) will be determined from all eligible entries received for the Sweepstakes prior to the action or compromise giving rise to the suspension or termination of the Sweepstakes. In the event of cancellation, abbreviation or suspension, Sponsor shall promptly post a notice on the Sweepstakes entry page to such effect.
IN NO EVENT WILL SPONSOR, ANY PARTICIPATING PROMOTIONAL COMPANIES, RELEASED PARTIES, OR PRIZE PROVIDERS, OR INSTAGRAM, FACEBOOK/META OR THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, OR RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESNTATIVES, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING INDIRECT, INCIDENTAL, LOST PROFITS, CONSEQUENTIAL, OR PUNITIVE, MULTIPLE, OR ADDITIONAL DAMAGES.


DISPUTES: Except where prohibited by applicable law, Entrants (or their parents or legal guardians) agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, before the appropriate federal or state court in New Jersey. Further, in any such dispute, under no circumstances will Entrants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental, indirect, lost profits, or consequential damages, or any other damages, including attorney’s fees, and Entrants (or their parents or legal guardians) further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Sweepstakes, shall be governed by, construed in accordance with, the laws of the State of New Jersey. By entering, Entrants (or their parents or legal guardians) consent to the exclusive jurisdiction and venue of the federal and state courts located in New Jersey.


WINNER LIST: The names of the Winners (“Winners List”) may be requested only after the Closing Date and no later than three months after the Closing Date. To receive the Winners List or a copy of the Official Rules and Regulations, send a self-addressed stamped envelope to Prize Fulfillment, 30 Knightsbridge Road, Suite 301 Piscataway, New Jersey 08854. Specify winner’s list, rules or winner’s list and rules in your request.

MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as “may” are used in these Official Rules, Sponsor has sole and absolute discretion. Headings are solely for convenience and will not be deemed to affect the meaning or intent of the Official Rules or any provision hereof. In the event there is discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
